BYU football: Bowl win would cap Tulsa's tragic year

FORT WORTH ? Amid a trying season, Tulsa has learned plenty about adversity.

The Golden Hurricane's 1-3 start on the field pales in comparison to the kind of hardship they've dealt with this year off the field.

Over the past nine months, Tulsa has seen three former players who were part of the team that defeated BYU in 2007 lose their lives.

Fifth-year senior Wilson Holloway lost his battle with Hodgkin's lymphoma in February. In September, linebacker George Clinkscale, who finished his eligibility in 2009, died from injuries sustained in a boxing match. Then four-year letterman Anthony Germany, a safety who finished his career in 2007, passed away after a short illness in October.

The numbers of all three players will be displayed on the Tulsa players' helmets when the Golden Hurricane meet BYU in the Armed Forces Bowl on Friday (10 a.m., MT, ESPN).

"This team has faced a lot of tragedy, with three former teammates dying," said Tulsa defensive coordinator Brent Guy. "They've faced a lot of adversity and ups and downs. That's the one thing about these guys ? they're going to battle. It gives perspective for the kids, to appreciate being healthy and being able to play college football. You learn how precious life is. One of the guys who died was in our locker room for homecoming. Three days later, he was gone. You never know, so you have to give your best every day. You always know you have to deal with some types of adversity, but not this much, especially not with death, and not with the death of teammates. That's what was so difficult about this. Winning the bowl game would be a nice way to cap this season off."

Under first-year coach Bill Blankenship, Tulsa (8-4) dropped three of its first four games, including defeats to nationally ranked Oklahoma, Oklahoma State and Boise State.

But the Golden Hurricane rebounded to win seven consecutive games before falling to nationally ranked Houston in the regular-season finale.

Senior quarterback G.J. Kinne has completed 64 percent of his passes for 2,876 yards and 25 touchdowns this season.

"Tulsa is a team that has a lot of grit and a lot of heart," said BYU coach Bronco Mendenhall. "That stems from their quarterback. He's a really, really good football player that makes plays, extends plays and finds a way to move the chains and lead their team. Their team takes on his identity."

Kinne can also make plays with his feet, as he has rushed for 400 yards and three TDs.

"He's very elusive, and he has nice feel for making people miss," Mendenhall said of Kinne. "I'm just impressed. He's confident, he's poised, he's tough. And he knows where the first-down markers are and he just finds a way to move his team. It will be a great challenge for us. Our players respect him."

Steve King: President Ron Paul Would Be 'Dangerous'

Iowa Rep. Steve King?s said Thursday that Rep. Ron Paul, one of the two co-frontrunners going into his state?s caucuses next week, is ?not dangerous unless he?s president.?

King told Politico that he thinks Paul?s supporters are uninformed, especially about his take on international affairs.

?I don?t think that the Paul supporters have really stepped back and thought about what would happen if Ron Paul were operating out of the Oval Office and the commander-in-chief of our armed forces,? King said.

Paul?s plan to pull all American troops back home would ?actually alter the course of the United States? destiny irreparably and in perpetuity.?

?If he wins here in Iowa, it means something,? Beyonce Gives Birth to Tiana-May Carter ... According to Twitter


Rumors about Beyonce giving birth are currently blowing up Twitter, but have yet to be confirmed by the singer, husband Jay-Z, or any reputable source for that matter.

So ... there you are.

The (very possibly made-up) consensus seems to be that Beyonce welcomed a girl into the world this week, and that the little bundle of joy is named Tiana-May Carter.

Twitter makes up cute names at least.

The rumors we've read online - again, these are just rumors from social media, not even celebrity gossip sources - say she was taken to St. Luke's Hospital in New York City, and overnight, word spread that she had delivered a daughter.

Multiple outlets have picked up the story, but all cited the growing buzz on Twitter as the source and nothing more. She's due in February, so it's probably baseless chatter at this point, but also not impossible for her to give birth early.

Twitter also made Jon Bon Jovi dead recently. At least this is a nicer rumor.

Either way, the final countdown, which began after Beyonce's pregnancy reveal at the MTV VMAs, to the birth of the most famous celebrity babies in years is either over, or close to being over. We'll keep you posted as we learn more!

DHS launches hot line for jailed immigrants (AP)

WASHINGTON ? The Homeland Security Department is launching a hot line for people jailed on immigration charges who believe they are victims of crime or may be U.S. citizens.

The toll free hot line ? 855-448-6903 ? will be staffed 24 hours a day and run by Immigration and Customs Enforcement to answer questions from people held in local jails about whether they may face deportation proceedings.

The hot line is the latest move by the Obama administration to address concerns about suspected illegal immigrants held in local jails. Earlier this month, Homeland Security ended agreements that had allowed deputies at an Arizona sheriff's office to check the immigration status of local jail inmates after a Justice Department report outlined allegations of racial profiling and discrimination against Latinos.

North Korea Vows No Change Despite New Leadership

PYONGYANG, North Korea (AP) -- North Korea is calling Kim Jong Un "Great Leader" as it hands another of Kim Jong Il's titles to his son and heir.

The powerful National Defense Commission on Friday said the country is "uniting around Great Leader comrade Kim Jong Un."

The commission also warned rival South Korea and the rest of the world not to expect any change after Kim Jong Il's death. The tough message comes as Kim's young son strengthens his position as supreme leader.

PYONGYANG, North Korea (AP) - North Korea warned rival South Korea and the rest of the world Friday not to expect any change after Kim Jong Il's death, sending a tough message as Kim's young son strengthened his position as supreme leader.

North Korea's powerful National Defense Commission said that the country would never deal with South Korean President Lee Myung-bak, a conservative who stopped a no-strings-attached aid policy toward the North in 2008, and that it would unite around new leader Kim Jong Un.

The stern message came a day after North Korea ended official mourning for Kim Jong Il and declared Kim Jong Un supreme leader of the ruling party and military at a massive public memorial for the elder Kim. The top levels of government have unified around Kim Jong Un, who is in late 20s, in the wake of his father's death Dec. 17.

"We declare solemnly and confidently that the foolish politicians around the world, including the puppet group in South Korea, should not expect any change from us," the National Defense Commission said in a statement. "We will never deal with the traitor group of Lee Myung-bak."

The commission said the "evil misdeeds" of the Lee administration reached a peak when it prevented South Koreans from visiting North Korea to pay respects to Kim Jong Il, except for two delegations led by a former first lady and a business leader, both of whose husbands had ties to North Korea.

The North's statement is a warning for Seoul not to take the new leadership lightly, said Koh Yu-hwan, a North Korea expert at Seoul's Dongguk University.

"It is also raising the stakes in case the South wants better relations so Pyongyang can extract greater concessions" during any later talks, Koh said. He added that it's "too early to say the North is dashing hopes for reforms."

Indeed, the North, while blasting the South's leader, offered a bit of hope for improved ties with the South, saying it "will continue to push hard toward the path of improved relations."

But it added that any better ties won't be "based on the deceitful ploys South Korea is employing by mixing 'toughness' and 'flexibility.'" Seoul has signaled a change in its approach toward Pyongyang in recent months, saying it will be more flexible in dealing with the North.

On Thursday, a somber Kim Jong Un, dubbed the Great Successor, stood with his head bowed at the Grand People's Study House, overlooking Kim Il Sung Square, named for his grandfather who founded modern North Korea. A sea of mourners gathered below.

"Respected Comrade Kim Jong Un is our party, military and country's supreme leader who inherits great comrade Kim Jong Il's ideology, leadership, character, virtues, grit and courage," Kim Yong Nam, considered North Korea's ceremonial head of state, said in a speech.

Kim Jong Un was flanked by top party and military officials, including Kim Jong Il's younger sister, Kim Kyong Hui, and her husband, Jang Song Thaek, who are expected to serve as mentors of their young nephew.

"The father's plan is being implemented," Ralph Cossa, president of Pacific Forum CSIS, a Hawaii-based think tank, said of the transfer of power. "All of these guys have a vested interest in the system and a vested interest in demonstrating stability. The last thing they want to do is create havoc."

Still, given Kim Jong Un's inexperience and age, there are questions outside North Korea about whether he is equipped to lead a nation engaged in long-stalled negotiations over its nuclear program and grappling with decades of economic hardship and chronic food shortages.

But support among North Korea's power brokers was clear at the memorial service, which was attended by hundreds of thousands of people filling Kim Il Sung Square and other plazas in central Pyongyang.

Some Chinese turn to U.S. Embassy for clarity in smog data

BEIJING ? The Beijing smog often keeps Zhushen Zhenyu trapped at home, on his mother's orders, when he'd rather be playing basketball outside, but the 8-year-old still hopes for a silver lining in the clouds of pollution choking China's capital.

"When will the air quality be so bad we don't have to go to school?" he asked a city official one recent smoggy day.

"That depends on government policy," was the cryptic reply of Li Yunting, an engineer at the Beijing Environmental Monitoring Center, which opened to public visits last month.

The doubts about official pollution data keep piling up for China's government, as green activists, celebrity bloggers and ordinary citizens increasingly demand action and information to halt the environmental fall-out from decades of breakneck economic growth.

Burning coal is largely responsible for the oppressive smog, which the United Nations has rated the worst in the world. China has more than doubled its coal consumption in the past 10 years but has not kept pace with the clean-air technology found in the West. It also relies on cheaper forms of coal that emit more pollutants, and Beijing's nearly 5 million cars do not generally meet the standards of the USA.

U.S. Embassy keeps tabs

The past two months have been dire. The high incidence of heavy air pollution has sent many residents rushing to buy face masks, air purifiers and household plants believed to clean dirty air.

The haze has highlighted discrepancies between the government's robustly sunny statistics and the far scarier numbers recorded and issued by the U.S. Embassy here. Beijing described the air pollution as "light" on December 4, a smog-filled day that forced the city airport, the world's second busiest, to cancel hundreds of flights because of poor visibility. The embassy reading was "beyond index," literally off the measurement charts that stop at "hazardous."

The embassy measurements, begun in 2008 and issued hourly via Twitter, use a standard employed by the U.S. Environmental Protection Agency to measure tiny airborne particles, such as soot from burning gas in cars, that are under 2.5 micrometers in diameter.

Experts consider these particles most damaging to human health, as they are small enough to penetrate the lungs and blood, potentially causing lung cancer and other diseases.

China publishes figures using a standard that measures coarser particular matter such as dust and keeps secret, for internal research, the measurements of smaller particles its scientists collect.

Despite the Chinese government's blocking of Twitter, the U.S. Embassy figures are widely circulated in Beijing on Chinese websites or microblogs. In recent weeks, celebrity bloggers such as real estate mogul Pan Shiyi and children's author Zheng Yuanjie have pressured Chinese officials to give a more accurate picture of air quality.

Yu Ping, a Beijing journalist and father of a 6-year-old boy who, like him, has suffered a sore throat in recent weeks, threatens to sue the municipal environmental protection agency if they don't respond to his request for the recent data.

"This is very important for me, my son and all citizens of Beijing and China," he says.

Yu's quest has inspired several other Chinese to demand data from their city governments, Yu says. He is grateful to the U.S. government for its transparency, but "it should be the Chinese government that does this," he says.

Some Beijingers, such as Wang Jinlan, say the U.S. government should mind its own business. Her daughter Du Lanxin, 8, says they filled their house with special plants last month to purify the air.

"Our home is better now, but when I go out, it's sometimes very hard to breathe," she says. Her mother drives her to school every day rather than breathe the smog on a bicycle or bus, but in doing so, she adds to the city's clogged, polluted streets.

Public 'won't understand'

Hua Lei, vice director of the center, insists that, over the past two years, Beijing's air quality has improved. She says the center measures small particulates in the air but does not release the data because the public "won't understand the figures."

Environmentalist Feng Yongfeng, founder of the environmental group Green Beagle, has been lending air-quality monitoring equipment to companies and communities since May.

"As a government, you must let the people know the worst level of air quality," he says.

Under growing pressure, Beijing is now revising national air-quality monitoring standards and promises to require the release of data on smaller particulates ? by 2016.

Environmental consultant Steven Andrews, an American based in Beijing, says the problem is that China's "target culture" means officials, fearful for their jobs, distort pollution levels to ensure they meet government benchmarks.

Even under the new standards, "levels will still be called good in Beijing that would be in the unhealthy range in the U.S," he says.

"The air is dangerous; it will cause cancer," says Sam Zhang, 41, a vegetable wholesaler who signed up for the monitoring center visit. He says he trusts the U.S. Embassy figures over his own government's data.

"Taxpayers pay the government officials' salaries, so they should tell the truth about air quality," he says, "but they are not elected by the people, so we have no hope they will tell the truth."

Jamie Dupree's Washington Insider: Republicans Give In

Whether you say that House GOP leaders "caved in" to Democrats or simply gave in to growing pressure within Republican ranks, it was a rough few days for Speaker John Boehner in his party's bid to forge a year-long extension of a payroll tax cut.

"It may not have been politically the smartest thing in the world," Boehner told reporters in announcing the deal with Senate Majority Leader Harry Reid for a two month extension, "but let me tell you what, I think our members waged a good fight."

A quick scan of news web sites though showed that the headlines were not so forgiving for Boehner.

"Payroll tax deadlock ends as House caves," said the Associated Press.

"Boehner caves in on tax cut deal," said ABC News.

Democrats were more than happy to pile on.

"It was about time the GOP put the needs of the middle class ahead of Tea Party politics and agreed to the payroll tax cut," said Rep. Debbie Wasserman Schulz (R-FL).

What did Republicans get in this deal? They got Democrats to agree to appoint negotiators to work out a one year extension of the payroll tax cut in coming weeks - before the next deadline of February 29.

On the Republican side, there was a lot of grumbling from the rank and file.

"I cannot support this concession," said Rep. Allen West (R-FL).

"It seems the politics of demagoguery have won over policy and principle with the concession to enact tax policy on two-month basis," West added.

"It is disappointing that since the Senate failed to do their job, we will now have to have this debate again in two months," said Rep. Scott DesJarlais (R-TN).

The plan is to approve the deal by "unanimous consent" - a term that's well understood in the halls of Congress, but not so well outside of Capitol Hill.

Basically it means that any lawmaker could object to the bill's passage - and if that happens, then Speaker Boehner would call the House back in to session to take a vote next week.

That would cost an estimated $4-5 million.

There was talk that someone would object to the deal; I asked one Republican if he would do that.

"No, that would just cost the taxpayers more money," he said before adding in the final verbal punch.

"They are getting screwed already," he added.

For a third straight year, the Congress is in session just a few days before the holiday break for lawmakers.

NORAD tracks Santa and you can, too, with the official app

Norad tracking Santa started back in 1955, pretty much by accident when a Colorado Springs-based Sears Roebuck & Co. advertisement accidentally printed the number to the Continental Air Defense Command center as the number to call in order to get in touch with Santa. Ever since then the Continental Air Defense Command center now known as NORAD has been tracking Santa every Christmas creating a tradition for many folks.

This year, a new Santa tracking app has been released and is now ready for download. With it, you can track Santa's progress as he travels across the world delivering presents to good boys and girls.

Plus, you can play the included Elf Toss game that is actually quite fun. You have to help the Elf's toss presents to Santa all while avoiding the holes in the ice -- otherwise, you may lose some presents and they won't make their way. Just remember -- Santa hasn't left the North Pole yet but when he does, this app will let you know. Download is past the break for you all.

And on Christmas Eve, you also can search for "Santa" in Google Maps and track that way.

Consumer, business spending point to slower growth (Reuters)

WASHINGTON (Reuters) ? U.S. consumer spending was tepid in November and a gauge of business investment plans fell for a second month, pointing to some loss of momentum in the economy as the year ends.

The Commerce Department said on Friday consumer spending ticked up 0.1 percent after rising by the same margin in October. Economists had expected spending, which accounts for two-thirds of U.S. economic activity, to rise 0.3 percent.

In another report, the department said non-defense capital goods orders excluding aircraft, a closely watched proxy for business spending, fell 1.2 percent last month after declining 0.9 percent in October.

While the reports suggest some slowing in activity, they are unlikely to change perceptions that economic growth will top 3 percent in the current quarter after a 1.8 percent pace in July-September, boosted in part by a rebound in inventories.

U.S. stock index futures pared gains on the data, while prices for U.S. government debt trimmed losses. The dollar fell against the euro.

The tepid consumer spending is in stark contrast with robust Black Friday business reported by retailers.

When adjusted for inflation, spending rose 0.2 percent last month after a similar gain in October. The government on Thursday revised down third-quarter consumer spending growth to a 1.7 percent annual pace from 2.3 percent because of a slump in spending at hospitals.

Income ticked up 0.1 percent last month, the weakest reading since August, after increasing 0.4 percent in October. Last month's increase was below economists' expectations for a 0.2 percent rise.

Taking inflation into account, disposable income was flat after rising 0.3 percent in October.

"The lack of real income growth really raises questions as to what is going to happen to the economy in the first quarter," said Mark Vitner, senior economist at Wells Fargo Securities in Charlotte, North Carolina.

The saving rate dipped to 3.5 percent last month from 3.6 percent in October. Savings slowed to annual rate of $400.9 billion from $419.1 billion the prior month.

The report showed subsiding inflation pressures, which should help to support spending.

A price index for personal spending was flat last month after falling 0.1 percent in October. In the 12 months through November, the PCE index was up 2.5 percent, the smallest rise since April. That followed a 2.7 percent increase in October.

A core inflation measure, which strips out food and energy costs, edged up 0.1 percent last month after a similar gain in October. In the 12 months through November, core PCE rose 1.7 percent after increasing 1.7 percent in September.

But the economy continues to show resilience in the face of slowing global demand. New orders for long-lasting manufactured goods jumped 3.8 percent after being flat in October.

Excluding transportation, orders rose 0.3 percent after rising 1.5 percent in October. Durable goods range from toasters to big-ticket items such as aircraft which are meant to last three years and more.

Harrison Ford takes command in 'Ender's Game'

harrison-ford-aug-2011-gi.jpgThe sci-fi novel "Ender's Game" is mostly about a young boy, and the movie adaptation scheduled for 2013 will be as well. But the film has landed a pretty big grown-up star to play opposite the young lead.

Harrison Ford has signed on to play Col. Hyrum Graff in "Ender's Game," Variety reports. The character is the commander of an elite battle school that trains kids to fight an interstellar enemy, and he quickly recognizes the special gifts the title character (Asa Butterfield of "Hugo") possesses.

The cast also includes Abigail Breslin ("New Year's Eve," "Zombieland") as Ender's sister Valentine, Hailee Steinfeld ("True Grit") as a battle school classmate and Ben Kingsley ("Hugo") as a war hero who takes Ender under his wing.

Gavin Hood ("Wolverine") is writing and directing the adaptation of Orson Scott Card's novel. "Ender's Game" is due for release in March 2013.

Googlers Get Galaxy Nexus Gift

Google has always been a great place to work, but occasionally stories leak out that make you want to immediately apply for a job. This is one of those stories ??happy Google employees are reporting that each of them are receiving a very special gift for Christmas ??their very own Samsung Galaxy Nexus. The Ice Cream Sandwich reference phone retails for roughly ?500 sim free, so that?s quite a Christmas bonus!

The Galaxy Nexus are a bit different than they normally look as well ??they?ve got a unique back cover that shows off Google?s iconography and gives a rather unique look to the phone, as you can see.

It?s not known if the phones are different in any other way. The changes could only be cosmetic, but knowing Google, I wouldn?t be surprised to learn if they ship with some custom firmware or perhaps an integrated Tazer or something.

Verizon in the midst of yet another major data outage

Well, that's no good. Verizon Wireless is dead in the water this morning for what appears to be, well, most everybody this morning. 3G data ... dead. 4G data ... dead. Pick a 3G/4G LTE phone. It's dead. Phone calls can still be made, which means we're not overly worried about public safety. But it's yet another outage for Verizon, which already is the subject of much signal scrutiny these days.

The high cost of child care

If you?re a working parent, chances are at some point you?ve bemoaned the high cost of child care.

The lower your income, the more likely you are to have reason to complain.

A recent graphic from CLASP, an advocacy group for low-income people, shows that families with working moms who live below the poverty line and have kids under 15 are spending 40 percent of their monthly income on child care expenses.

That?s a more than 10 percentage point increase from 2002, according to CLASP.

Both sets of data are based on information from the U.S. Census Bureau, and they exclude people who are getting child care for free or from a family member, government or charity program. The most recent data was released in the spring of 2010.

Hannah Matthews, the director of child care and early education for CLASP, said it?s not clear why child care costs have increased so substantially for very low-income families. One hypothesis is that child care costs are going up while incomes are dropping or staying steady.

The 40 percent figure is also very high in comparison to families who earn 200 percent above the poverty line, or more. Those families are paying just 7 percent of their monthly income in child care expenses.

Matthews noted that many families in the 7 percent range also likely feel pained by that child care bill.

?It?s 7 percent of their income and feels like such a large amount. It?s striking to think about what it feels like for a family that?s in the 40 percent chart there - what they?re dealing with just to make ends meet,? she said.

RIVERSIDE, Calif. ? "At Last" and "Tell Mama" blues singer Etta James, whose health has been fading in recent years, is now terminally ill, and her live-in doctor is asking for prayers.

Dr. Elaine James, who isn't related to the 73-year-old entertainer, tells the Riverside Press-Enterprise ( http://bit.ly/tVMtaN) that the singer's chronic leukemia was declared incurable two weeks ago.

The doctor has cared for Etta James at the singer's Riverside, Calif., area home since March 2010.

Elaine James says she's spreading word of the singer's ailments so people will pray for her. She says fans know Etta James has been sick "but not how sick."

Court records in the singer's probate case show she also suffers from dementia and kidney failure.

Elaine James made her comments outside a Riverside conservatorship hearing over the singer's $1 million estate. The singer's son, Donto James, wants a conservator rather than the singer's husband, Artis Mills.

McQueary: I saw Sandusky sex abuse

A Penn State assistant football coach testified Friday that he had no doubt he saw former assistant coach Jerry Sandusky in a sexual act with a boy in a university locker room in 2002.

"I believe he was sexually molesting the boy," Mike McQueary, a graduate assistant in the university's football program in 2002, said at a court hearing, adding at a later point that he "has no doubt" he saw Sandusky in a sexual act.

McQueary, speaking for the first time in public about the 2002 encounter, said he saw Sandusky with his hands around the boy's waist. McQueary also said he fully conveyed what he had seen to two Penn State administrators about what he told them. He testified that he reported the incident to longtime head coach Joe Paterno.

McQueary took the stand Friday morning in a Pennsylvania courtroom during a preliminary hearing for Tim Curley and Gary Schultz, the two university officials who are accused of lying to a grand jury. The hearing was expected to last most of the day.

Since Curley's and Schultz's arrests, different versions of what McQueary witnessed have been reported. They testified to the grand jury that McQueary never relayed the seriousness of what he saw. The officials, and Paterno, have been criticized for not telling police about the 2002 allegation. Prosecutors say Sandusky continued to abuse boys for at least six more years.

McQueary told the court on Friday that he had gone into the building one night around 9 p.m. in the spring of 2002 after watching a football movie at home, which he said had motivated him to go into the building and get some work done, reported NBC News.

When he went into the locker room that night to drop off a pair of sneakers, McQueary said he saw a naked Sandusky behind a prepubescent boy he estimated to be 10 or 12 years old, with Sandusky's hands wrapped around the boy's waist. He said the boy was facing a wall, with his hands on it.

'Shocked, horrified'
"I heard rhythmic slapping sounds, two or three slaps that sounded like skin on skin," McQueary testified.

But McQueary also said: "I did not see insertion nor was there any protest, screaming or yelling."

He said he was "shocked, horrified, not thinking straight. I was distraught."

He said he looked into the shower several times and that the last time he looked in, Sandusky and the boy had separated. He said he didn't say anything, but "I know they saw me. They looked directly in my eye, both of them."

The position was very "sexually oriented," McQueary said.

Under cross examination by an attorney for Curley, McQueary reiterated that he had not seen Sandusky penetrating or fondling the boy but was nearly certain he knew a sexual assault happened, in part because the two were standing so close and Sandusky's arms were wrapped around the youth.

McQueary, 27 at the time, said he called his father, John McQueary, immediately afterward and told him: "I just saw coach Sandusky. What I saw was wrong and sexual."

His father told him he needed to to report what he saw to Paterno, McQueary told the court.

McQueary then testified that he called Paterno early the following morning and told him he needed to speak with him about something.

He said he did not give Paterno explicit details of what he believed he'd seen, saying he wouldn't have used terms like sodomy or anal intercourse out of respect for the longtime coach.

Paterno told him, "I'm sorry you had to see that" and that he had "done the absolute right thing," McQueary said. The head coach appeared shocked and saddened and slumped back in his chair, McQueary said.

Paterno told McQueary he would talk to others about what he'd reported.


Nine or 10 days later, McQueary said he met with Curley and Shultz and told them he'd seen Sandusky and a boy, both naked, in the shower after hearing skin-on-skin slapping sounds.

"I told them that I saw Jerry in the showers with a young boy and that what I had seen was extremely sexual and over the lines and it was wrong," McQueary said. "I would have described that it was extremely sexual and I thought that some kind of intercourse was going on."

Spoke with university officials, not police
McQueary said he was left with the impression both men took his report seriously. When asked why he didn't go to police, he referenced Shultz's position as a vice president at the university who had overseen the campus police.

"I thought I was talking to the head of the police, to be frank with you," he said. "In my mind it was like speaking to a (district attorney). It was someone who police reported to and would know what to do with it."

Later, Thomas Harmon, the former chief of the Penn State police department, testified Schultz didn't tell him about the shower allegation.

Paterno, Schultz and Curley didn't testify, but District Judge William C. Wenner read their grand jury testimony from January in weighing the case.

Curley and Schultz are charged with lying to a grand jury and failing to properly report what McQueary allegedly told them. Their lawyers say the men are innocent and contest McQueary's statements.

Wenner was hearing testimony Friday to help him decide whether state prosecutors have enough evidence against the pair to send their cases to trial.

Sandusky says he is innocent of more than 50 charges stemming from what authorities say were sexual assaults over 15 years on 10 boys in his home, on Penn State property and elsewhere. The scandal has provoked strong criticism that Penn State officials didn't do enough to stop Sandusky, and prompted the departures of Hall of Fame football coach Joe Paterno and the school's longtime president, Graham Spanier.

Sandusky waived his preliminary hearing on Tuesday and will go straight to trial on 52 counts of sex abuse of boys over a 15-year period.

Curley, 57, Penn State's athletic director, was placed on leave by the university after his arrest. Schultz, 62, returned to retirement after spending about four decades at the school, most recently as senior vice president for business and finance, and treasurer.

Curley and Schultz testified to the grand jury that McQueary never relayed the seriousness of what he saw and that they told Spanier what they knew before telling Sandusky not to bring children on to campus.

Paterno was fired after the scandal broke.
